When to use it
After a notice to end tenancy (N5, N6, N7, N8, N12, or N13) has been served and the termination date has passed, and the tenant remains in the unit. Also used for abandoned units.
What happens next
The LTB schedules a hearing to order eviction (and rent owed, if applicable). Filing fee: $186 (online) paid to the LTB.
Note: The LTB charges a separate government filing fee ($186 online / $201 by mail), paid directly to the LTB when you file.
Common mistakes
- ✗Filing before the termination date has passed
- ✗Not having proof of compensation payment (N12 and N13 cases)
- ✗Not including a Certificate of Service for the original notice
