Understanding Rent Arrears in Ontario

Rent arrears occur when a tenant fails to pay rent on the date it is due under their tenancy agreement. In Ontario, the Residential Tenancies Act (RTA) governs the process landlords must follow to address non-payment of rent. Understanding your rights and obligations is the first step toward resolving the situation.

When Can You File for Non-Payment?

As a landlord in Ontario, you can begin the formal process as soon as rent is one day late. The first step is serving an N4 Notice to End a Tenancy Early for Non-payment of Rent. This notice gives the tenant 14 days to either pay the full amount owed or vacate the rental unit. If the tenant pays in full within the notice period, the notice is void and the tenancy continues.

The LTB Filing Process

If the tenant does not pay or move out by the termination date on the N4 notice, the landlord can file an L1 Application to Evict a Tenant for Non-payment of Rent with the Landlord and Tenant Board. The L1 filing fee is $186 (online) or $201 (paper), which can be included in the amount claimed from the tenant. The Board will schedule a hearing where both parties can present their case.
