When to use it
When a tenant is damaging the property, making excessive noise, or interfering with others' reasonable enjoyment.
What happens next
First N5: tenant has 20 days to fix the problem. If they do, the notice is void. Second N5 within 6 months: only 14 days, cannot be voided. You can then file an application.
Common mistakes
- ✗Not documenting incidents with dates, times, and witnesses
- ✗Filing an application on the first N5 before the void period ends
- ✗Using N7 when N5 is appropriate (N7 is for serious safety hazards only)
