Notice to End Tenancy at End of the Term — Persistent Late Payment

Serve an N8 when your tenant has persistently paid rent late (3+ times in a 12-month period). Requires 60 days notice, terminating at the end of a rental period. N8 wizard is currently under construction.

Landlords whose tenant has repeatedly paid rent late or misrepresented their income to get the unit

When to use it

When a tenant has been persistently late paying rent (3+ times in a 12-month period) or misrepresented their income during the application process. Notice period: 60 days to end of the term.

What happens next

The tenant cannot void an N8 by paying — it ends the tenancy at end of the rental period. If the tenant doesn't vacate, you can file an L2 application with the LTB.

Common mistakes

  • Using N8 for a one-time late payment — you need a pattern of 3+ late payments
  • Confusing N8 with N5 — N5 is for unauthorized sublets/occupants
  • Not documenting each late payment instance with dates and amounts
  • Serving the notice mid-term without correct end-of-term termination date
