When a tenant has wilfully caused serious damage, seriously impaired the safety of another person, or used the unit in a manner causing serious damage. 10-day notice with no void period. Note: use N5 for overcrowding or negligent damage.
What happens next
The tenant has 10 days and cannot void the notice by fixing the problem. After the termination date, you can file an L2 application with the LTB.
Common mistakes
- ✗Using N7 for overcrowding or minor issues — N5 applies there (20-day, voidable)
- ✗Using N7 for negligent (accidental) damage — you need to prove the damage was wilful
- ✗Not documenting the hazard or damage thoroughly
